The People's Republic of China has announced, via the office of the State Council關(guān)稅稅則委員會(huì), that starting October 1, 2024, a 100% tariff will be imposed on electric vehicles imported from Canada; and starting October 22, 2024, a 25% tariff will also be applied to steel and aluminum products from Canada. Such unilateral tariff measures by Canada contravening objective facts and the fundamental principles of the World Trade Organization, amount to discrimination against the Chinese side and severely infringe upon the legitimate rights and interests of the Chinese side, thereby severely damaging the economic relations between Canada and China.

In accordance with the legal statutes and regulations of the People's Republic of China, including《中華人民共和國關(guān)稅法》,《中華人民共和國海關(guān)法》, and《中華人民共和國對(duì)外貿(mào)易法》, as well as the basic principles of international law, with the consent of the State Council, the People's Republic of China has decided, via the office of the State Council關(guān)稅稅則委員會(huì), to impose tariffs of 100% on imported sunflower oil, oil cake, peas, and 25% on water products and pork imports from Canada, starting March 20, 2025. The Chinese side strongly urges Canada to view the bilateral trade relations rationally, to respect objective facts, to adhere to the basic principles of the World Trade Organization, and to promptly correct its erroneous measures.

According to the provisions of《中華人民共和國對(duì)外貿(mào)易法》, specifically Article 7, Section 36, and Section 37, the China Ministry of Commerce, acting as the調(diào)查機(jī)關(guān) (Investigation Agency), issued the 商務(wù)部第2024年第40號(hào)公告 (Commercial Ministry 2024 No. 40 Notice) on September 26, 2024, initiates an anti-discrimination investigation into measures imposed by Canada on certain electric vehicles and steel and aluminum products from China, which are referred to as the measures under investigation.

The調(diào)查機(jī)關(guān) investigated whether the measures under investigation constituted discrimination under the provisions of Article 7 of《中華人民共和國對(duì)外貿(mào)易法》, i.e., prohibitions, restrictions, or other similar measures that discriminate in trade. Based on the findings of the investigation and the provisions of the law, the調(diào)查機(jī)關(guān) has made the following determination:

一、裁決

The investigation agency has determined that the measures under investigation by Canada constitute discrimination against the Chinese side as defined in Article 7 of《中華人民共和國對(duì)外貿(mào)易法》, impairing normal trade order and causing severe negative impacts on the Chinese side.

二、反歧視措施

《中華人民共和國對(duì)外貿(mào)易法》和《中華人民共和國關(guān)稅法》明確規(guī)定，實(shí)施反歧視措施。對(duì)原產(chǎn)自加拿大進(jìn)口的部分商品，將加征關(guān)稅。具體措施將另行發(fā)布。

三、措施調(diào)整

在以下情形出現(xiàn)時(shí)，上述措施可經(jīng)程序調(diào)整、暫?；蚪K止，包括：（一）被調(diào)查國政府已對(duì)原被調(diào)查措施作出調(diào)整或取消；（二）被調(diào)查國政府已就造成的損害提供適當(dāng)補(bǔ)償；（三）雙方已通過磋商達(dá)成一致的解決方案；（四）被調(diào)查國政府采取了實(shí)質(zhì)性限制措施；（五）其它適當(dāng)情況。

四、本公告自2025年3月8日起實(shí)施。

答：加拿大方不顧中方多次交涉和勸告，未經(jīng)調(diào)查便對(duì)自華進(jìn)口的電動(dòng)車輛、鋼鐵和鋁等產(chǎn)品實(shí)施單邊限制，破壞了中加經(jīng)貿(mào)關(guān)系，中方對(duì)此表示強(qiáng)烈不滿和堅(jiān)決反對(duì)。根據(jù)《中華人民共和國對(duì)外貿(mào)易法》的規(guī)定，商務(wù)部長(zhǎng)于2024年9月26日就加拿大實(shí)施的限制性措施啟動(dòng)了反歧視調(diào)查。

調(diào)查發(fā)現(xiàn)，加拿大實(shí)施的相關(guān)措施構(gòu)成歧視性限制，破壞了正常貿(mào)易秩序，損害了中國企業(yè)的正當(dāng)合法權(quán)益。中方因此決定，根據(jù)《中華人民共和國對(duì)外貿(mào)易法》《中華人民共和國關(guān)稅法》等相關(guān)法律規(guī)定，對(duì)自加進(jìn)口部分商品加征關(guān)稅。

中方敦促加拿大立即糾正錯(cuò)誤，取消限制措施，消除不利影響。
